Payment Terms Currently we accept only credit or debit card from customers in the United Kingdom through our online shopping system. We accept Visa, Delta, Electron, Switch, UK Maestro and Mastercard. Payments are taken through our SagePay gateway which uses a 3D secure (verified by Visa and Mastercard Securecode), AVS and CV2 fraud prevention checks, along with various fraud prevention measures and Bank of Scotland Merchant Services and are fully PCI DSS compliant. Payment must be received for the whole of the price of your order, and any applicable charges for carriage and insurance, before your order can be accepted, unless we have agreed otherwise in writing. No payment shall be deemed to have been received until Inverness Catering Centre Limited has received cleared funds. Title of goods is reserved by Inverness Catering Centre Limited until payment of the purchase price is made in full. Our retention of title, Until payment in full is received, the Buyer or Landlord must permit Inverness Catering Centre Limited or their agents to enter the Buyer or Landlord's premises to re-possess the goods. The Buyer shall make all payments due under the Contract without deductions whether by way of set-off, counterclaim, discount, abatement or otherwise unless the Buyer has a valid court order requiring an amount equal to be paid by Inverness Catering Centre Limited to the Buyer. Warranty All Goods supplied by Inverness Catering Centre Limited are supplied in accordance with the manufacturers warranty provided with the goods or for one year if not stated with the goods. If any product proves defective within one year of purchase we will repair it at no cost to you. The warranty applies to U.K. Mainland Only and does not apply to goods that have not been paid in full. Please fill in any warranty cards received with your appliance, as soon as possible, and always within 14 days of receipt to validate your warranty. Inverness Catering Centre will not be under any liability in respect of any defect or failure arising in goods due to wilful damage or misuse, negligence by the customer or third party, failure to follow the manufacturers instruction (including cleaning and de-scaling where appropriate) or alterations or repairs to goods without prior consent by Inverness Catering Centre Limited. Warranty does not apply to wear and tear, bulbs, glass, seals, perishables, goods that have been damaged by fire, water or smoke and goods that have exceeded their warranty period. It does not apply to a small number of machines marked "No Commercial Warranty" where any warranty is invalidated if the machine has been used, or deemed to have been used in a commercial environment. Items marked "back to base" or "workshop" warranty must be returned to our workshop or the manufacturers workshop for repair. It is the responsibilty of the user for the safe delivery and collection of these goods. Where damage/fault is due to operator misuse, failure to comply with manufacturers instructions, accidental damage, without fault, failure to maintain the equipment or neglect or not been used as it was designed for, it will be charged for. We will contact you prior to doing this, wherever possible. Wherever possible, an engineer's report will be provided. When a claim under warranty is submitted, to Inverness Catering Centre Limited, customers will be required to give security payments against non-warranty call outs/repairs. This can be taken against credit/debit card at our discretion. Machines returned for repair are not reassembled if upon quotation the repair is not required. Inverness Catering Centre Limited's obligation, under this warranty, will be limited at the Inverness Catering Centre Limited's option to repairing or replacing ex-works, or allowing credit for, any part of which under normal and proper use and maintenance proves, to Inverness Catering Centre Limited's satisfaction, to be defective in material and workmanship within twelve months of the original date of purchase, provided notice of such defect and satifactory proof there of should be promptly given to the Company at it's request. All labour, travel or carriage costs involved in effecting such replacements or repairs shall be bourne by the buyer. Delivery Delivery is free of charge to the customer for United Kingdom Mainland addresses only. For Offshore and remote areas, including Northern Ireland, Isle of Man, Isle of Wight, Channel Islands, Alderney and Scottish Islands a supplementary delivery cost may apply. Please call for a quotation. The delivery date shown on the acknowledgement, from Inverness Catering Centre Limited, shall be regarded as an estimate. All products are subject to availability. The Buyer must ensure that all products will fit through doorways and onto premises, Inverness Catering Centre Limited will not accept responsibility if it does not fit. The goods shall be deemed to be delivered when deposited at the address at the address designated by the Buyer. It is the Buyers responsibility to ensure that they have sufficient staff and equipment to safely take receipt of the goods from the carrier. All products include delivery to the door/kerbside (ground floor only) and does not include going on the premises, negotiating stairs or lifts, unpacking, positioning or assembling items. Inverness Catering Centre Limited will only be held liable for damaged goods when the Goods are signed for as "received damaged". Goods must be checked upon receipt, before you sign the delivery note. If you sign the delivery note and have not checked the items Inverness Catering Centre Limited will not be held responsible for any claims that later arise through damage or missing items. All damages and/or shortages must be reported within 24 hours, along with written notification to be recieved within three working days (to allow for Carrier claims) otherwise no claim can be made and Inverness Catering Centre Limited will accept no liability. Any carriage charges caused by aborted delivery are the Buyers responsibility. Subject to the other provisions of these Conditions, Inverness Catering Centre Limited, will not be liable for any direct, indirect or consequential loss (all three of which terms include, without limitation, loss of business, depletion of goodwill and like loss), costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery of the Goods (even if caused by Inverness Catering Centre Limited's negligence). Any delay in delivery will not entitle the Buyer to cancel the order. Inverness Catering Centre Limited will not be liable for failure or delay of the goods, if it is due to an event beyond the reasonable control of the Company. The Buyer must ensure that someone is on site to accept and sign for delivery. Any signature taken to accept delivery is binding. If for any reason the Buyer will not accept delivery of any of the Goods when they are ready for delivery, or if the Company is unable to deliver the Goods on time because the Buyer has not provided appropriate instructions, documents, licences or authorisations: Risk in the Goods will pass to the Buyer (including for loss or damage caused by the Company's negligence). The Goods will be deemed to have been delivered. The Company may store the Goods until delivery, whereupon the Buyer will be liable for all related costs and expenses (including without limitation, storage and insurance). For larger machinery or refrigeration, where a delivery attempt has been made and failed, due to customer error, a subsequent delivery charge may be made. Back Order: If your item is not in stock, we will back order it for you. You will always be e-mailed with the option to cancel your order if you would rather not wait. Returns Goods supplied against a firm order may not be returned without the Buyer applying for, and receiving, the consent of Inverness Catering Centre Limited, at which time a Goods Return Authorisation Number will be issued. Goods which have been incorrectly ordered or are unsuitable (unless an incorrect item has been received) will be subject to a re-stocking charge of 25%. Returns can only be considered if the Goods are undamaged, unused and still in their original packaging, with original manuals. Any item to be returned must be notified within 7 days of receipt and received within 14 days. Any goods returned without authorisation or which are not in the condition set out above will be rejected and returned to the Buyer, at the Buyers expense. The Buyer is responsible for returning Goods, ensuring all Goods are suitably packed and obtaining necessary proof of delivery and receipt. Carriage charges for returning any Goods shall be the responsibilty of the Buyer. Goods are not sold on a trial basis. Goods supplied by special order, that are not listed on our website, may not be returned unless they are damaged on delivery or faulty. Cancellation Buyers who need to cancel an order must notify Inverness Catering Centre Limited as soon as possible and always within seven days. The Buyer shall be responsible for all shipping costs on orders that have been shipped prior to cancellation, or that are refused at the time of delivery. Inverness Catering Centre Limited reserves the right to charge a restocking fee on all cancellations and/or a 10% cancellation charge. Cancellations cannot be accepted for goods supplied by special order, that are not listed on our website, once they have been shipped. Electrical Product Recycling The cost for collection and disposal of oligatory electrical items, as specified in the WEEE directive, is not included in the selling price. However, upon request at the end of product life, collection and disposal can be arranged for a fee. When ordering like for like replacements, if the disposal of the old unit(s) is required, they must be unplugged/disconnected from power supply, empty and in a reasonable state for transportation. Item(s) must be ready for collection at the time of ordering replacement(s). Installation Inverness Catering Centre Limited does not install the Goods supplied, unless specifically stated. Installation, where available, will be specified as an option. Buyers are advised to aquaint themselves with the manufacturers requirements for supply of water, electricity, gas/LPG and product spacing, to ensure the Goods are correctly installed and the warranty is not invalidated. Installation should only be carried out by qualified personnel. It is the Buyers responsibility to be aware of all current legislation relating to the installation and usage regulations of the appliances ordered. Inverness Catering Centre Limited will not accept any responsibility if the Buyer is unaware of any legislation relating to the installation or usage of any item. Accuracy of Information Whilst every effort has been made to provide current photographs, descriptions and specifications, Inverness Catering Centre Limited and all featured manufacturers reserve the right to change specifications, illustrations, model numbers and appearance of any item without prior notification and therefore will not be held responsible for any variations. Inverness Catering Centre Limited reserve the right to amend or delete product information without notice. Prices shown on Inverness Catering Centre Limited's website may be subject to alteration or withdrawal without notice. Any errors contained in Inverness Catering Centre Limited's price list, website, acknowledgement or invoice shall be rectified by the Company when discovered and notified to the Buyer. Buyer and Inverness Catering Centre Limited shall have the option to settle any outstanding amounts or cancel the order. The inclusion of a hyperlink should not be taken as an endorsement by Inverness Catering Centre Limited and the Company cannot guarantee the accuracy of, or be responsible for, information on websites it does not manage. Exclusion of Liability i. We shall not be liable in any way for any loss of revenue, profit, goodwill or any consequential or indirect loss or damage arising out of the purchase of any goods by you from us, or late or non delivery of goods. ii. Any liability not excluded by paragraph (a) above (or any exclusion of liability which is held by a court of competent jurisdiction to be invalid or unreasonable) shall be limited to a maximum aggregate liability per claim of £50,000.00 iii. You agree and confirm that you are in a better position than us to assess and estimate any likely damage or loss that you may incur in connection with the order of any goods from us and that we cannot therefore insure any likely damage for which we have excluded liability under this clause. iv. Nothing in this clause shall exclude liability for death or personal injury arising from negligence of Inverness Catering Centre Limited, its employees or its agents, or any other liability which it is prohibited from excluding by law. Force Majeure Neither party shall be liable for any default due to any act of God, war, strike, lock out industrial action, fire or other event beyond the reasonable control of either party. Tax For all prices displayed on this site are exclusive of VAT, which will be added to the final value of the order at the current applicable rate. All prices quoted by Inverness Catering Centre are exclusive of VAT at the standard rate.
